This Privacy Policy explains how Modelware LLC, a California limited liability company ("Modelware", "we", "us", or "our"), collects, uses, shares, and protects personal information. It covers the modelware.io website and its subdomains, the Modelware products and hosted services, Modelware Academy, and our sales and support interactions (together, the "Services").
This policy describes what Modelware does as a business with information about you. It is referenced by the Terms of Service, the End User License Agreement, and the Website Terms of Use. Where Modelware instead processes personal data on a customer's behalf inside the Services, the Data Processing Agreement governs that processing, as described in the section on Customer Data below.
1Scope
This policy applies where Modelware acts as the controller of personal information, meaning we decide why and how it is processed. That covers visitors to our website, people who contact us or request a demo, people who buy from us, and the individual users of our products and Academy courses.
This policy does not apply to a third party's own handling of your information. Where you buy through our online checkout, our merchant of record is the seller for that transaction and processes your payment details under its own privacy notice, as described in the Payments section. Where an organization licenses our Services and you use them as that organization's user, the organization sets the terms for the data you put into the Services.
2Information We Collect
Information you give us. When you contact us, request a demo, subscribe to updates, register an account, or enroll in a course, we collect the details you provide. This typically includes your name, email address, employer or organization, job title, and the content of your message or request.
Purchase and transaction information. When you buy from us, we receive a record of the transaction: what was purchased, the amount and currency, the date, the country used for tax purposes, your billing name and email, and a truncated payment identifier such as the last four digits and card type. We do not collect or store full payment card numbers. Where our merchant of record handles the sale, it collects your full payment details directly and provides us only the transaction record described here.
Account and license information. If you hold an account or a software license, we collect account identifiers, the licenses assigned to you, and license-validation and usage metrics reported by the software, as described in the End User License Agreement.
Information collected automatically. When you visit our website, we and our analytics providers may collect your IP address, approximate location derived from it, browser and device type, operating system, referring page, the pages you view, and the dates and times of your visits. On our website this collection beyond what is strictly necessary depends on your cookie choice, as described in the Cookies section.
Support and service data. When you contact support, we collect the correspondence and any diagnostic information, logs, or files you choose to send us.
Sensitive information. We do not seek to collect sensitive or special-category personal information, such as government identifiers, health data, biometric data, precise geolocation, or information about racial or ethnic origin, religious beliefs, or sexual orientation. Please do not send it to us.
3How We Use Information
We use personal information to:
(a)provide, operate, maintain, and secure the Services, and provide support;
(b)process purchases, issue and validate licenses, and keep records of transactions;
(c)respond to your enquiries, demo requests, and support requests;
(d)administer accounts, course enrollment, and access to purchased materials;
(e)send service and transactional messages, such as receipts, license notices, renewal or cancellation reminders, security alerts, and changes to our terms;
(f)send marketing communications where you have asked to receive them or where otherwise permitted by law, which you can stop at any time;
(g)understand how our website and Services are used, measure the effectiveness of our marketing, and improve our products and content;
(h)detect, investigate, and prevent fraud, abuse, security incidents, and violations of our terms; and
(i)comply with legal, tax, accounting, and export-control obligations, and establish or defend legal claims.
We do not sell personal information, and we do not use it to train artificial-intelligence models for our own purposes or for third parties.
4Legal Bases (EEA/UK)
If you are in the European Economic Area or the United Kingdom, we rely on the following legal bases. We process information to perform a contract with you, such as providing the Services and processing a purchase. We rely on our legitimate interests to secure the Services, prevent fraud and abuse, respond to business enquiries, and understand and improve how our products are used, where doing so does not override your rights. We rely on your consent for non-essential cookies and analytics, and for marketing emails where consent is required, and you may withdraw it at any time. We process information to comply with legal obligations such as tax, accounting, and export-control requirements.
6Payments and Merchant of Record
Purchases made through our online checkout are sold by Paddle, Modelware's authorized reseller and merchant of record. Paddle, rather than Modelware, is the seller for that transaction and is an independent controller of the payment information you give it. Paddle collects and processes your payment card or other payment details, billing address, and the information it needs for tax determination, invoicing, and fraud and chargeback handling, under its own privacy notice available at paddle.com/legal. Paddle appears on your statement in place of Modelware.
Modelware does not receive or store your full payment card details. From a completed transaction we receive the record described in the Information We Collect section, which we use to fulfil your order, provide support, decide refund requests under the Refund Policy, and meet our tax and accounting obligations.
Where you buy under a written agreement, quotation, or invoice with Modelware rather than through the online checkout, Modelware is the seller, Paddle is not involved, and we process your billing and payment details ourselves for that transaction.
8Customer Data and the DPA
The Services let customers submit their own data, including models, files, and content, which may contain personal information about the customer's own users, employees, or other individuals. Modelware processes that Customer Data on the customer's behalf and on the customer's instructions, as a processor rather than a controller. Our obligations for that processing, including security measures, sub-processors, breach notification, international transfers, and deletion, are set out in the Data Processing Agreement, and the Terms of Service confirm that customers retain ownership of their Customer Data.
If your personal information is contained in a customer's Customer Data and you want to exercise a privacy right over it, contact that customer, who is the controller. If you contact us directly, we will refer you to them unless the law requires otherwise.
9How Long We Keep Information
We keep personal information only as long as we need it for the purposes described in this policy, and then delete it or remove its association with you. In practice, we keep account and license records for as long as the account or license is active and for a reasonable period afterwards; transaction and tax records for the period required by applicable tax and accounting law, which is generally at least seven years; enquiry and support correspondence for as long as needed to handle the matter and keep a reasonable record of it; and marketing contact details until you unsubscribe or we conclude the contact is no longer active. Where deletion is not immediately possible, for example because information is held in a backup, we isolate it from further processing until deletion is possible. Customer Data is returned or deleted as set out in the Terms of Service and the Data Processing Agreement.
10Security
We maintain administrative, technical, and physical safeguards designed to protect personal information, including access controls and least-privilege access, encryption of data in transit and, where applicable, at rest, network and system protections, logging and monitoring, secure development and change-management practices, personnel confidentiality obligations, and backup and recovery procedures. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your personal information, we will notify you and any regulator as required by law.
11International Transfers
Modelware is based in the United States and hosts the Modelware Academy platform there, and our service providers may be located in other countries, so your information may be transferred to, stored in, and processed in a country whose data-protection laws differ from those where you live. Where we transfer personal information out of the European Economic Area, the United Kingdom, or Switzerland to a country that has not been found to provide an adequate level of protection, we rely on an appropriate safeguard, such as the Standard Contractual Clauses approved by the European Commission together with the UK addendum where applicable. You may request information about the safeguard used for a particular transfer by contacting us.
12Your Privacy Rights
Depending on where you live, you may have the right to request access to the personal information we hold about you, to have it corrected or deleted, to receive a portable copy, to restrict or object to certain processing, to withdraw consent you have given, and not to be subject to unlawful discrimination for exercising these rights. Where we rely on legitimate interests, you may object to that processing. You can also unsubscribe from marketing email at any time using the link in any marketing message.
To make a request, email info@modelware.io. We will verify your request, usually by confirming control of the email address concerned, and respond within the period required by applicable law. We do not charge a fee for a reasonable request. An authorized agent may submit a request on your behalf with proof of authority. If you are in the European Economic Area or the United Kingdom, you may also lodge a complaint with your local supervisory authority, and if you are in Switzerland, with the Federal Data Protection and Information Commissioner.
13U.S. State Privacy Rights
Several U.S. states, including California, Colorado, Connecticut, Utah, Virginia, and Texas, give residents rights over their personal information. Subject to the exceptions in the applicable statute, residents of those states may request to know or access the personal information we have collected, request its correction or deletion, obtain a portable copy, and opt out of the sale of personal information, of targeted advertising, and of certain profiling.
Sale and targeted advertising. Modelware does not sell personal information for money. We use analytics and advertising-measurement technologies, described in the Cookies section, that some state laws treat as a "sale" or as "sharing" or "targeted advertising" because information is made available to those providers. We load them on our website only if you accept non-essential cookies, so declining, or clearing your cookie choice and declining, serves as your opt-out for this website. You may also email info@modelware.io to opt out.
Categories. In the twelve months before the date of this policy, and going forward, the categories of personal information we collect are identifiers such as name, email address, and IP address; commercial information such as records of purchases and transactions; internet or network activity such as website usage and interactions with our content; professional information such as employer and job title; and the contents of communications you send us. We collect these from you directly, automatically through our website, and from our service providers, and we use and disclose them for the business purposes described in this policy. We do not collect biometric information, precise geolocation, or sensitive personal information as defined by those statutes, and we do not knowingly collect personal information from anyone under 18.
California "Shine the Light". California residents may request information about our disclosure of personal information to third parties for their direct marketing purposes. We do not make such disclosures.
14Children
The Services are intended for business and professional use by adults. We do not direct the Services to children, and we do not knowingly collect personal information from anyone under 18 years of age. If you believe a child has provided us personal information, contact info@modelware.io and we will delete it.
15Do-Not-Track Signals
No uniform standard for responding to browser Do-Not-Track signals has been adopted, and we do not currently respond to them. We do honor the cookie choice you make on our website, which controls whether analytics and measurement technologies load at all. If a recognized standard is established, we will update this policy and our practices.
16Changes to This Policy
We may update this policy from time to time. If we make material changes, we will communicate them by reasonable means, such as posting a notice on our website or emailing you, and the updated policy takes effect on the date stated in the notice. Where applicable law requires your consent to a change, we will obtain it.
